If you are sending employees abroad there are two key pieces of legislation that address risk to your employees, these are:
- Health & Safety at Work Act 1974 (HASAW)
- Corporate Manslaughter and Corporate Homicide Act 2007
Health & Safety at Work Act 1974 enshrines the ‘Duty of Care’ that must be given to employees.
Subsection 2.2(c) of the Act states the employer’s duty as being ……
the provision of such information, instruction, training and supervision as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of his employees
Should your Company fail in having sound Policies & Procedures to ensure as far as reasonably practicable the safety of employees and an employee is injured or killed whilst travelling for your Company then legal proceedings could occur under HASAW and the Corporate Manslaughter Act.
The Corporate Manslaughter and Corporate Homicide Act 2007
Is a landmark in UK law. For the first time, companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care.
